Welcome to SnakeDrafts! These Terms of Use ("Terms") govern your access to and use of the SnakeDrafts mobile application and related services (collectively, the "Service"). By creating an account or using SnakeDrafts, you agree to these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms
By accessing or using SnakeDrafts, you confirm that you are at least 13 years old (or 16 in the European Economic Area) and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have obtained permission from a parent or guardian to use the Service.
2. Eligibility
SnakeDrafts is intended for users aged 13 and older (16 and older in the EEA). We do not knowingly permit children under these ages to create accounts or use the Service.
You agree to provide accurate information when creating your account and to keep your login credentials secure. You are responsible for all activity that occurs under your account.
3. Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to:

- Accept responsibility for all activity under your account
4. User Conduct
You agree to use SnakeDrafts in a lawful and respectful manner. You will not:
- Post or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
- Impersonate any person or entity, or falsely represent your affiliation with anyone
- Engage in any form of harassment, bullying, or hate speech
- Upload or transmit viruses, malware, or any other harmful code
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
- Use automated systems (bots, scripts, scrapers) to access or interact with the Service
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Violate any applicable local, state, national, or international law
- Collect or store personal data about other users without their explicit consent
Violation of these conduct rules may result in immediate suspension or termination of your account.
5. Content and Intellectual Property
You retain ownership of any content you create, upload, or share through SnakeDrafts, including draft picks, chat messages, avatars, and images. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.
You represent and warrant that you own or have the necessary rights to all content you post, and that your content does not violate any third-party rights or applicable laws.
All other content, features, functionality, and materials on the Service, including the SnakeDrafts name, logo, and design, are owned by SnakeDrafts and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.
6. Drafts and Gameplay
SnakeDrafts is a social game for entertainment purposes. We strive to provide a fair and enjoyable experience, but we do not guarantee uninterrupted or error-free gameplay. Game results, including draft outcomes and rankings, are determined by the app's features and user participation.
SnakeDrafts does not involve wagering, betting, or any real-money prizes. It is intended solely for social entertainment.
Any disputes regarding game results should be resolved among participants. SnakeDrafts is not responsible for disagreements between users or the outcome of any draft.
7. Groups and Chat
SnakeDrafts provides group chat functionality to enhance your social experience. You agree to use chat features respectfully and in accordance with our community guidelines.
You may report or block other users within the app. When you report content or a user, our team or authorized moderators may review the report and take appropriate action, which may include removing content, issuing warnings, or suspending accounts.
Blocking another user hides their messages from your view but does not remove either user from shared groups. We are not responsible for interactions between users, but we reserve the right to moderate content and enforce these Terms.
8. Moderation and Content Removal
We reserve the right, but do not assume the obligation, to monitor, review, and remove any content or user accounts that violate these Terms or our community standards. We may use a combination of automated tools and human review to enforce moderation. We may take action without prior notice if we determine, in our sole discretion, that content or behavior is harmful, illegal, or inappropriate.
Moderation decisions are made to maintain a safe and enjoyable environment for all users. We may suspend or terminate accounts for violations of these Terms, including repeated or severe misconduct.
9. Third-Party Services
SnakeDrafts integrates with third-party services, including:
- Apple and Google for authentication and app distribution
- Supabase for hosting, authentication, and data storage
- PostHog for product analytics
- Expo Services for push notifications
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions, policies, or content of third-party providers.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no guarantees regarding the accuracy, reliability, or completeness of any content or features. Your use of the Service is at your own risk.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNAKEDRAFTS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless SnakeDrafts and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you post or share.
13. Termination
You may terminate your account at any time by contacting us at support@snakedrafts.app or using the account deletion feature within the app.
We reserve the right to suspend or terminate your account, with or without notice, if we determine that you have violated these Terms or engaged in conduct that we deem harmful to the Service or other users. Upon termination, your right to use the Service will immediately cease, and we may delete your account and associated data in accordance with our Privacy Policy.
14. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
Any disputes arising out of or related to these Terms or the Service shall be resolved through good-faith negotiations. If a dispute cannot be resolved, you agree to submit to the exclusive jurisdiction of the state or federal courts located in Marin County, California for resolution.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, features, or legal requirements. The most current version will always be available at https://snakedrafts.app/terms. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnakeDrafts regarding your use of the Service.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms at any time without restriction.
